Global Standards Are Setting the Pace 

The EU AI Act established a risk-based framework that categorizes AI systems from "minimal risk" to "unacceptable risk." For law firms, most marketing and client-facing tools fall under limited or high-risk categories, meaning they require transparency, traceability, and human oversight. 

Even if your firm operates exclusively in the U.S., these standards matter. If you serve international clients or work with platforms built under EU compliance requirements, indirect obligations may apply. 

U.S. Bars Are Catching Up

AI can generate persuasive language quickly, but persuasiveness doesn't equal accuracy. Before any claim goes live, trace it back to a reliable source: case law, peer-reviewed studies, government data, or verified client outcomes. 

Compare these two approaches: 

  • "Our firm has helped thousands of accident victims recover millions in damages." 
  • "Since 2018, our firm has represented over 1,200 clients in personal injury cases, recovering $47M in settlements and verdicts." 

The first is vague and unverifiable. The second is specific, dated, and tied to actual outcomes. Include citations, dates, and jurisdictions. If AI generated the statement, verify it before publication. Treat AI output like a first draft from an intern: helpful, but not yet trustworthy. 

Protect Sensitive Data 

AI tools learn from the data you feed them. That means confidential client information, case details, and privileged communications should never enter a public AI system without careful segmentation and encryption. 

Use private, enterprise-grade AI platforms with data residency guarantees. Strip identifying information before feeding documents into AI tools. Encrypt any stored data and limit access to approved personnel. Treat AI prompts like you would client emails: assume they could be discoverable. 

Disclose AI Involvement Where It Matters 

Transparency builds trust. If AI meaningfully contributed to client-facing materials like blog posts, case summaries, or intake forms, note that assistance clearly. 

You don't need a disclaimer on every page, but readers and regulators should understand when AI played a role in content creation. Simple language works: "This article was drafted with AI assistance and reviewed by licensed attorneys." 

Keep Human Gates in Place 

AI can draft, but humans must decide. Establish clear review checkpoints before any content goes live. 

Legal review validates claims, citations, and disclaimers. Compliance review ensures adherence to bar rules and advertising standards. Brand review confirms tone, readability, and alignment with firm positioning. 

Every piece of AI-assisted content should pass through these gates before publication. No exceptions. 

Hidden Risks: Bias, Attribution, and Disclosure  

AI bias is one of the most subtle and dangerous risks for plaintiff firms. Models trained on historical data can inadvertently reinforce stereotypes, especially around protected classes, injury types, or damage calculations. 

Use structured rubrics when addressing sensitive topics such as discrimination, disability, catastrophic injury, or wrongful death. Review not only for factual accuracy but for tone, framing, and implied assumptions. 

Ask these questions: Does this language unintentionally minimize the severity of certain injuries? Does this framing favor one demographic over another? Could this statement be interpreted as a guarantee or promise of results? 

Attribution Matters 

Readers and regulators need to know where numbers come from and how they were derived. Avoid sweeping generalizations like "most clients see significant recoveries" or "our firm consistently wins large verdicts." 

Instead, provide context: "In 2024, 78% of our closed cases resulted in settlements above the initial insurance offer, with an average increase of $43,000." 

Specific, sourced claims build credibility. Vague superlatives erode it.

A Compliant AI Workflow  

AI's benefits become sustainable when they're built into a repeatable, auditable process. 

Start by drafting using approved sources. AI retrieves information from curated, authoritative libraries: case law databases, medical literature, firm-approved templates. No open-ended web scraping or unverified sources. 

Next, a compliance agent (AI-powered or human) scans for risky language: guarantees, superlatives, unverified claims, or missing disclaimers. 

Then a licensed attorney reviews factual claims, citations, and legal disclaimers. This step is non-negotiable. No AI output should bypass attorney review before publication. 

Marketing or content leads confirm tone, readability, and alignment with firm positioning. AI-generated content should sound like your firm, not like every other firm using the same tool. 

Finally, publish with an audit trail. Every step is logged: who drafted, who reviewed, who approved, and when. If a regulator or opposing counsel questions a claim, you can show exactly how it was validated. 

This structure creates both accountability and speed. You'll know who checked what, when, and why, and you'll avoid the "we thought someone else checked it" problem.

Training the Team  

Policies alone don't build good habits. Practice does. Your team needs to understand the rules and how to apply them in real scenarios. 

Skip the long manuals. Run short, practical workshops instead. Show a compliant claim next to a risky one and ask: what's the difference? Walk through real examples from your firm's content library. Practice flagging issues before they become problems. 

Create an internal resource hub with approved phrases and disclaimers, citation formats and sourcing standards, examples of compliant testimonials and case descriptions, and common pitfalls to avoid. Update it as laws, tools, and best practices evolve. Treat it as both compliance documentation and brand quality control. 

Every quarter, review a sample of your firm's published content and intake workflows. Look for gaps in data handling or citation practices, patterns of risky language that slipped through review, and opportunities to tighten disclosure or attribution standards. 

Treat audits as learning opportunities, not blame exercises. The goal is continuous improvement, not perfection on day one.
